I still don’t think that by collecting data, that should automatically make that data available to any other company who wants to access it. It depends wholly on the terms under which that information was gathered and in the cases of UGC, why the user chose to submit it and what expectations they had. This argument that the secret sauce must be “developed” rather than “collected” I think underestimates the importance and value of organizing information. Patent law has developed to protect invention and copyright law has developed to protect creation of unique works. We might actually want new laws that help users protect their data and more concretely lay out the responsibilities of companies that collect them to protect them too
